The petitioner has preferred the present writ petition with the grievance that petitioner’s application for grant of construction approval, which was filed on 27.06.2019 is still pending consideration before the respondent No.2.

Learned counsel invited Court’s attention towards the various reports given/forwarded by the Commissioner, Municipal Board, Mount Abu so also the Patwari, Delwara indicating that the area in question does not fall in the prohibited area and the petitioner can raise construction and submitted that on account of respondents’ inaction petitioner’s rights of enjoying his property are being defeated.

In view of the aforesaid, the present writ petition is disposed of with a direction to the petitioner to file a representation within a period of two weeks along with photo-stat copy of the application

dated 27.06.2019; other requisite documents and a certified copy of the order instant.

In case, a representation is so addressed within the aforesaid period, the Commissioner, Municipal Board, Mount Abu shall consider and decide the same in accordance with law as early as possible preferably within a period of eight weeks.

It is made clear that aforesaid direction to decide the representation has been issued only with a view to ensure expeditious redressal of petitioner’s grievance. The same may not be construed to be an order to decide the representation in a particular manner.

The stay application also stands disposed of accordingly.
