Although, the matter comes up on an application No.1/2021 for early listing but, on the oral request of the learned counsels for the respective parties, the writ petition was heard on merit.

In the writ petition, it has been prayed that the services rendered by the petitioner in State Cooperative Sheep and Wool Marketing Federation Ltd, may be counted for the purpose of grant of pensionary benefits to the petitioner.

Learned counsel for the petitioner submitted that the controversy herein is no more res integra and stands resolved by a co-ordinate Bench judgment of this Court dated 11.07.2018 in

Learned counsel for the respondents did not dispute the aforesaid position but, submitted that judgment in case of R.S. Trivedi & Anr. (supra) is subject matter of challenge by way of D.B. Special Appeal (Writ) No.919/2019, State of Rajasthan

Vs. R.S. Trivedi and Anr. and hence, right of the petitioner may be subjected to decision in the special appeal (writ).

Learned counsel for the petitioner did not have any objection to the aforesaid prayer.

In view thereof, this writ petition is disposed of in terms of direction issued by this Court in case of R.S. Trivedi & Anr. (supra) which shall apply mutatis mutandis to the present case also. However, right of the petitioner for pension shall remain subject to decision of the D.B. Special Appeal (Writ) No.919/2019.

The pending application stands disposed of accordingly.
