The present petitions are in relation to the selection conducted by the respondents for the post of Community Health Officer (CHO). The post is of contractual in nature.

The grievances of the petitioners are manifold, however, short issue involved is that the certificates like of not having been submitted OBC (Non-Creamy Layer) Certificate, Sports Certificate, wrongful mentioning of category and in one case matter relates to wrongful mentioning in the form being “male” instead of “female” are some of the issues raised.

The second aspect which the petitioners have pointed out is that while the respondents had opened the portal for submitting grievances between 10.03.2021 to 15.03.2021, the same was not accessible to several of the petitioners and they could not raise their grievances. Resultantly, several petitions have not come before this court.

No.3110/2021 restrained the respondents from declaring the result in order to avoid complicacies.

The Officer-Incharge and the concerned persons who are dealing with the selection process namely Dr. Rummel Singh and Dr.Surya Pratap Singh are present in the court and they have informed the court that an attempt was made to deal with all the grievances which came up before them and opportunity was given to candidates by opening the portal. The submission of learned counsel that the portal was not accessible, is also not correct as the respondents have received several grievances which were meted out. However, faced with the situation that there are several flood of cases which are coming up before the court, the concerned officers of the Department have pointed out that the result is required to be declared at the earliest and pray that the stay be vacated.

Learned counsel appearing for the Department submits that if the petitioners have not properly filled their forms, they should not be given any further indulgence. However, he has placed before me copy of the order passed on 23.3.2021 by the Principal Seat Jodhpur in SBCWP No.3882/2021 Suman Choudhary Versus State of Rajasthan & Another alongwith connected matters wherein the Principal Seat was examining the issue relating to OBC (Non-Creamy Layer) category. The application form was suspended on the ground that the certificate contained was under Creamy Layer but actually it is Non-Creamy Layer. It was stated by the petitioners therein that they have submitted their grievances on online portal but were not being addressed and the court therefore directed that the grievances in terms of communication dated 19.03.2021 be addressed to within a period

of two weeks from today. The writ petition was accordingly disposed of.

I have considered the aforesaid order and also considered the issues as noticed above.

Before this court, the grievances of the petitioners are manifold as noticed above. The appointment is on contract basis for the post of CHO and therefore, the rules which are framed under the provisions of Article 9 of the Constitution of India may not be required to be strictly observed and candidature of candidates on the ground that the forms did not contain all the documents details may not be a reason enough for canceling their candidature. It is noticed that the respondents have not cancelled the candidature who have suspended by communication certificate, the petitioners have approached this court while the respondents have stated that portal was opened from 10.03.2021 to 15.03.2021.

This court notices that some of the petitions have been filed even earlier to 10.03.2021 before this court. 10. Keeping in view the aforesaid aspects and in order to resolve all the issues, the petitioners are now directed to submit their grievances within two weeks from the date of the order passed by the Principal Seat of this court at Jodhpur i.e. upto 07.04.2021 in order to maintain parity. The grievances may be submitted online or by offline applications with documents to the Office of Project Director, NHM who is stated to be examining the forms. No further chance shall be given to any person to move their grievance. This order shall be applicable to even to those candidates who have not approached this court in order to avoid further litigation and the respondents shall duly published in prominent newspapers

regarding the present order. The respondents shall consider the grievances and if it is found that the said applicants’ grievances is genuine and supported with documents, the same shall be duly redressed.

Such candidates’ names would be included and if they are found in merit, they will be considered for the placement in the select list. So far as the result of other candidates are concerned, the same cannot be declared in piecemeal method. It is accordingly directed that the result of all the candidates including those who are submitting their grievances upto 07.04.2021 shall be declared together at the earliest.

The result shall be declared positively by 09.04.2021. 13. After pronouncement of the aforesaid order, the OfficerIncharge of NHM submits that a penalty of 25% is likely to be imposed if the result is declared after 31.03.2021. In view of the directions given by this court and Principal Seat of this Court at Jodhpur, it is observed that no penalty shall be applicable on the State Government for delay in declaration of result as it is on account of an order passed by the court.

The writ petitions are accordingly disposed of. All pending applications shall stand disposed of.
