At the outset, counsel for the petitioners Mr. Rajesh Shah submits that the same day notice of the Tehsildar shows non application of mind and also arbitrariness in the decision for removing the petitioners as encroachers.

Learned counsel for the respondents assures the Court that they shall give an opportunity of hearing to the present petitioners and pass necessary orders expeditiously.

The interim orders in favour of the petitioners are continuing for last six years.

¶23

In view of the above, the writ petitions are disposed of while directing the petitioners to submits the representation within a period of 30 days from today. Thereafter, the respondents shall consider and decide the representation of the petitioner by passing a speaking order within a period of three months from today, strictly in accordance with law.

In the meanwhile, status quo, as it exists today, regarding land in question, shall be maintained by the parties for next three months only.

¶25

All pending applications also stand disposed of accordingly.
