It has been submitted on behalf of the petitioners that a bare perusal of the charge-sheet would reveal that no case is made out against the petitioners and during investigation, it was found that on 15.08.2020, Smt. Yogita (wife of petitioner-Dilip Kumar) had fallen from roof of the house and got injured. She was rushed to hospital by family members of the petitioner for proper medication and treatment, where she was admitted in ICU. The deceased (Smt. Yogita) has stated in her Parcha Bayan that her husband did not harass her. FIR was lodged after a delay of nine days with ulterior motive to harass and blackmail the petitioners. There are contradictions between the FIR and Parcha Bayan of the deceased. Statements of prosecution witnesses recorded under Section 161 of Cr.P.C. disclose that the deceased was never subjected to harassment with regard to demand of dowry or otherwise. Smt. Yogita died due to accidental fall. The police also recorded statement of treating doctor, who deposed that the victim told him that she fell from height. Thus, this is a case of accidental fall for which no culpability of petitioners can be inferred.
