In wake of second surge in the COVID-19 cases, abundant caution is being maintained, while hearing the matters in Court, for the safety of all concerned.

Learned counsel for the petitioners submits that there is over implication in the case. Learned counsel for the petitioners further submits that there are two incidents which have been intermingled by the investigating agency to cause prejudice to the petitioners.

Learned P.P. assisted by the I.O. submits that the out of total 15, offence has been found to be proved against 8 persons. The petitioners No. 3 and 5 are yet to be arrested.

This Court examined the case diary and particularly the suicide note in which the names of petitioners No.3 and 5 are also there. Thus, this Court is not inclined to interfere in the present

petition at this stage in exercise of its power under Section 482 Cr.P.C.

In view of above, this misc. petition is dismissed. However, the petitioners are given liberty to submit a representation to the concerned investigating officer who shall decide the same before completing the investigation, strictly in accordance with law. All pending applications also stand disposed of.
