In wake of second surge in the COVID-19 cases, abundant caution is being maintained, while hearing the matters in Court, for the safety of all concerned.

Learned counsel for the petitioner submits that the investigation has been wrongly done as the stand of submitting

the pistol has been wrongly mentioned as earlier it was mentioned that on 16.10.2018, the same was deposited upon the death of Late Shri Bhag Singh, on the other hand, now police is taking a stand that it was an error and actually the gun was submitting even when the death had not happened because the death has happened subsequently in the year 2020.

Learned Public Prosecutor has submitted the factual report, which indicates that the investigation done by the police is satisfactory as the gun is admittedly in the possession of the police and the proper owner of the gun shall be entitled to get it released in accordance with law.

In view of the above, no interference is call for in the present petition and the same is accordingly dismissed. Stay petition also stands dismissed.
