Instant petition has been preferred under Section 482 Cr.P.C. praying therein that the order dated 02.03.2021 passed by the learned Judicial Magistrate, Uniyara, District Tonk (Raj.), whereby the learned Judicial Magistrate has taken the cognizance against the accused petitioners for the offence(s) under Sections 323, 341, 325, 308 read with 34 IPC.

Learned counsel for the petitioners submits that after investigation, the Investigating Agency has filed the charge-sheet against the petitioners under Sections 341, 323 and 325/34 IPC.

After that, complainant had filed the application before the trial court for taking cognizance under Section 308 IPC. Trial Court vide order dated 02.03.2021 took cognizance against the petitioner under Section 308 IPC also. Learned counsel for the petitioners also submits that trial court has directed to present accusedpetitioners on the date 08.03.2021. Learned counsel for the petitioners also submits that petitioners had limited prayer, they will raise all the arguments for taking the cognizance at the time of arguments of the charge but petitioners be protected for the bail.

Petitioners are directed to appear before the trial court within 10 days. Trial court is directed to enlarge the petitioners on bail of their satisfaction.

In view of above, the present petition is disposed of.
