The criminal misc. petition has been preferred by the petitioners who stated that they were complainants in the FIR No.176/2018 and were holding the charge as a Purchase Incharge and Handling In-charge of the Store Room where it was shown that material namely, 303 sets of Mustard and 1617 sets of Chana were missing.

It is stated that the accused Amzad Ali preferred a Criminal Misc. Petition No.1559/2019 and this court granted indulgence to the said accused to place on record the relevant documents before the concerned IO vide order date 23.4.2019.

Learned counsel submits that in the garb of order passed by the court, the IO has now turned around his investigation as against the petitioner.

Having noticed the aforesaid facts, this court is satisfied that the petitioner should be granted liberty to submit all relevant documents to the IO who will examine the same and thereafter complete the investigation by giving cogent reasons.

The criminal misc. petition is disposed of accordingly at this stage.
