The instant criminal misc. petition has been filed by the petitioner for conversion of standing arrest warrant in bailable warrant issued by the learned Addl. Chief Judicial Magistrate, Hanumangarh in criminal case No.851/2010.
Learned counsel for the petitioner submits that the petitioner could not appear since long and now he is ready to appear before the trial Court. In such circumstances, a limited prayer has been made that the arrest warrant so issued against the petitioner may be converted into bailable warrant and the petitioner is ready to appear before the trial court.
Learned Public Prosecutor opposed the prayer made by the counsel for the petitioner.

I have heard counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record. Petitioner was not present before the Court since long. In such circumstances, no case for converting the arrest warrant into bailable warrant is made out. Hence, the instant criminal misc. petition filed by the petitioner is hereby dismissed. However, petitioner is directed to surrender before the concerned trial Court on or before 16.03.2021 and file an appropriate application and it is expected from the concerned trial Court that the application filed by the petitioner will be decided on the same day.
Till 16.03.2021, the petitioner shall not be arrested.
Stay petition is also dismissed.
