At the very outset, learned counsel for the petitioner seeks permission of this Court to withdraw the bail application of petitioner No.2-Sunil @ Sonu with liberty to file afresh after recording statements of material witnesses.

The present bail application has been filed under Section 439 Cr.P.C. The petitioner No.1-Smt. Badam Bai has been arrested in connection with FIR No. 104/2021 Registered at Police Station Dei, District Bundi for the offence(s) under Sections 147, 149, 302, 307, 323 and 341 IPC.

Learned counsel for the petitioner submits that the petitioner No.1-Smt. Badam Bai has been wrongly implicated in this case.

She is behind the bars since long and conclusion of trial may take long time.

Learned Public Prosecutor has opposed the bail application of petitioner No.1-Smt. Badam Bai.

Considering the contentions put-forth by the counsel for the petitioner and taking into account the facts and circumstances of the case and without expressing any opinion on the merits of the case, this court deems it just and proper to enlarge the petitioner No.1-Smt. Badam Bai on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is partly allowed and it is ordered that the accused-petitioner No.1- Smt. Badam Bai W/o Hemraj shall be enlarged on bail provided she furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for her appearance before the court concerned on all the dates of hearing as and when called upon to do so and that application on the part of petitioner No.2-Sunil @ Sonu is dismissed as withdrawn with liberty, as prayed for.
