Petitioner has filed this bail application under Section 439 Cr.P.C.

F.I.R. No.01/2021 was registered at Police Station C.B.N. Kota Distt. Kota rajasthan for offence under Sections 8/18(b) & 8/29 of NDPS Act.

It is contended by counsel for the petitioner that recovery of contraband was effected from Vishnu. Petitioner is an employee of Vishnu. On the interrogation of Vishnu, it is revealed that petitioner got the car repaired and then co-accused asked to accompany him and he readily agreed. It is also contended that contraband was kept beneath the driver seat by Vishnu. Vishnu was driving the car. The car broke down and after some time they

were arrested by the Bureau Officers. It is further contended that petitioner is not having any criminal antecedents. He was only a Munshi working in the kota stone factory of Vishnu.

Counsel for Union of India has opposed the bail application. It is contended that petitioner was aware that contraband was being transported. The matter pertains to commercial quantity.

I have considered the contentions.

Considering the contentions put forth by counsel for the petitioner, I deem it proper to allow the bail application.

This bail application is, accordingly, allowed and it is directed that accused-petitioner shall be released on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the trial Court with the stipulation that he shall appear before that Court and any Court to which the matter be transferred, on all subsequent dates of hearing and as and when called upon to do so.

However, it is made clear that if the petitioner repeats the offence, State would be free to move application for cancellation of bail before the concerned Court.
