In wake of second surge in the COVID-19 cases, abundant caution is being maintained, while hearing the matters in Court, for the safety of all concerned.
The petitioners have been arrested in connection with FIR No.49/2021 of Police Station Jhotwara, Jaipur for the offences punishable under Sections 364A, 302, 120B of IPC. They have preferred these bail applications under Section 439 Cr.P.C.
Learned counsel for the parties have submitted the brief details of the case, in which the allegation was that one Kamlesh was picked up by one of the accomplices on account of a past animosity between the parties, and thereafter, he was taken from place to place before being killed.
Learned counsels for the petitioners submit that the names of the petitioners do not occur in the list of main accused persons, and in fact, no role has been assigned to them.
Learned counsels for the petitioners have also demonstrated from the charge-sheet that the allegation coming upon the present petitioners are vague and they are not directly supported by any recovery or scientific evidence.
This Court has seen the record of the case and finds that at this stage, the evidence which is there in the charge-sheet does not indicate any reason so as to grant bail to the present petitioners.
Consequently, the present bail applications are dismissed.
