Heard learned counsel for the petitioner as well as learned Public Prosecutor on second bail application.

Learned counsel for the petitioner stated that at the time of rejection of first bail application, liberty was granted to the petitioner to file fresh bail application after statements of material witnesses, viz., Vijay Singh and Jitendra Singh. It is further submitted that statement of material witness - Vijay Singh has been recorded before learned trial Court.

Learned Public Prosecutor has opposed the second bail application and stated that statement of material witness – Jitendra Singh has not been recorded before learned trial Court.

In the facts and circumstances of the case, since condition imposed at the time of first bail application to file file fresh bail

application after statements of material witnesses, viz., Vijay Singh and Jitendra Singh is not fulfilled, the instant second bail application is rejected. However, accused-petitioner is free to file fresh bail application after fulfilling the condition of first bail application.
