The present bail application has been filed under Section 439 Cr.P.C. on behalf of the applicant, who is in custody in connection with FIR No.34/2020, Police Station Sadar, District – Sriganganagar for the offences under Sections 8/22 and 29 of the NDPS Act.

It is submitted by learned counsel for the applicant that similarly placed accused Bhanwar Ram and Raju Ram have been granted bail by a coordinate Bench of this Court in S.B. Criminal Misc. Bail Application No. 6665/2020 on 14.08.2020 who were hauled up on account of the statements given by the applicant and the applicant has been implicated based on the statement of Jawahar Lal and, therefore, as the similarly placed accused have been granted bail, the applicant may also be enlarged on bail as challan has already been filed and the trial is likely to take time.

Learned Public Prosecutor opposed the bail application, however, indicated that the case of the applicant is similar to that of Bhanwar Ram and Raju Ram.

In the circumstances of the case, without expressing any opinion on the merits of the case, this Court is of the opinion that the bail application filed by the applicant deserves to be accepted.

Consequently, the bail application is allowed. It is ordered that the accused-applicant – Uttam Singh S/o Rajkumar arrested in connection with FIR No.34/2020, Police Station Sadar, District – Sriganganagar, shall be released on bail; provided he furnishs a personal bond of Rs.50,000/- (Rupees Fifty Thousand Only) with two sureties of Rs.25,000/- (Rupees Twenty Five Thousand Only) each to the satisfaction of the learned trial court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
