Before this Court is an application under Section 439 Cr.P.C. preferred on behalf of petitioner, who has been arrested in connection with FIR No.50/2018 registered at Police Station Bilara, District Jodhpur for the offence punishable under Sections 8/15, 8/29 NDPS Act.

Learned counsel for the petitioner submits that investigation has been completed. Police has filed charge-sheet against the present petitioner under Section 8/15 & 25 NDPS Act. The vehicle alleged to be involved in transporting the contraband is in the name of Jetha Ram, with whom it is alleged that present petitioner has executed an agreement to purchase the said vehicle. As per prosecution story, on the information recorded under Section 27 Indian Evidence Act, this agreement has been recovered from the possession of the present petitioner. Learned counsel for the petitioner prays to enlarge the petitioner on bail.

Learned Public Prosecutor has opposed to grant of bail to the petitioner. As per his contention, two other cases under NDPS Act are pending against the petitioner.

Having considered rival contentions of the learned counsel for the parties and material available on record, without commenting on the merits of the case, this Court deem it just and proper to enlarge accused-petitioner on bail under Section 439 Cr.P.C.

Accordingly, this bail application filed under Section 439 Cr.P.C. is allowed and it is directed that petitioner Shrawan Ram S/o Mangi Lal shall be released on bail in connection with FIR No.50/2018 registered at Police Station Bilara, District Jodhpur provided he executes a personal bond in the sum of Rs.1,00,000/with two sound and solvent sureties of Rs.50,000/- each to the satisfaction of learned trial court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
