These bail applications have been filed under Section 438 CrPC. in connection with FIR No.22/2021 registered at Police Station Shyam Nagar, Jaipur for the offences under Sections 323, 341, 382, 143, 365, 511, 457 & 354 of IPC and in FIR No.26/2021 registered at Police Station, Shyam Nagar, Jaipur City (South) for the offences under Sections 143, 323, 341, 452 & 427 of IPC whereupon the investigation was commenced. Apprehending their arrest, the petitioners moved the bail applications before the court below, which were dismissed. Hence, the present bail applications have been filed.

There are cross cases registered as well as civil suit pending between the parties.

Learned counsel for the petitioners submits that chargesheet was filed in relation to the FIR against other persons who have already been granted bail. So far as the investigation against the petitioners are concerned, the same was kept pending and now in order to pressurize the petitioners they are being sought to be arrested.

Learned counsel appearing for the complainant does not dispute that there are civil dispute as well as criminal cases registered between the parties however submits that cross FIR of the civil dispute have been registered after lodging an FIR by the complainant.

Keeping in view thereto, this court finds that it is a fit case where the petitioners deserve to be granted anticipatory bail.

Without commenting further on merits, these bail

applications filed under Section 438 CrPC are allowed and it is directed that in the event of arrest of petitioners- (1) Vijay Singh S/o Shri Om Prakash Yadav, (2) Ankur Chittosiya S/o Shri Jagdish Chandra Yadav, (3) Vijay Singh S/o Shri Om Prakash Yadav, & (4) Mahendra Jangid S/o Shri Bhagwan Sahay, in the aforesaid FIRs, they shall be released on bail by the concerned SHO/Investigating Officer, provided each of them furnishes a personal bond in the sum of Rs. 20,000/- with two sureties each of the like amount to his satisfaction on the following conditions:

i) That the petitioners shall make themselves available for interrogation by a police officer, as and when required;

¶29

ii) That the petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, so as to dissuade him from disclosing such facts to the court or to any police officer;

iii) That the petitioners shall not leave India without previous permission of the court;

¶31

iv) That the petitioners shall not commit any offence similar to the offence of which they are accused or suspected.
