This application for anticipatory bail under Section 438 CrPC has been filed by the petitioner apprehending his arrest in connection with FIR No.187/2020 registered at Police Station Panchu, District Bikaner for offences punishable under Sections 354 IPC and 67 of Information Technology Act, 2000.

Learned counsel for the petitioner submits that offences alleged against the present petitioner under Section 354 IPC is bailable; offence 67 of Information Technology Act, 2000 is also levelled against the petitioner to disentitle him from his right of bail; FIR No.187/2020 has been alleged against the present petitioner in counter blast to the FIR No.163/2020 lodged by the petitioner against the complainant party under Sections 323, 341, 365, 382 & 143 IPC etc on 11.09.2020. Learned counsel for the petitioner prays to grant anticipatory bail to the petitioner.

Learned Public Prosecutor opposes the grant of bail to the petitioner.

Having regard to the totality of the facts and circumstances of the case, without expressing any opinion on merits of the case, this Court deems it just and proper to grant anticipatory bail to the accused-petitioner under Section 438 CrPC.

Accordingly, this bail application under Section 438 CrPC is allowed and it is ordered that in the event of arrest of petitioner Hans Raj S/o Shankar Lal in connection with FIR No. 187/2020 registered at Police Station Panchu, District Bikaner shall be enlarged on bail provided he executes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) with two sound & solvent sureties of Rs.50,000/-(Rupees Fifty Thousand only) each, to the satisfaction of concerned I.O./S.H.O. on the following conditions:

1. The petitioner shall make himself available for interrogation by the Investigation Officer as & when required;

1. The petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any Police officer;

1. The petitioner shall not leave India without prior permission of the court.
