The present second bail application has been filed under Section 439 Cr.P.C. The petitioner has been arrested in connection with FIR No.47/2006 registered at Police Station Khandela, District Sikar for the offence(s) under Sections 147, 148, 149, 323, 302, 435 & 379 of I.P.C.

Counsel for the petitioner submits that the petitioner has been falsely implicated in this matter. Counsel further submits that eight other criminal cases are pending against the petitioner which have already been disposed of and the petitioner is behind the bars since 07.08.2013. Counsel further submits that the coaccused-Raju Thehath@ Rajendra@richhapal has already been released on bail by the Coordinate Bench of this Court vide order dated 14.12.2020 passed in S.B. Criminal Misc. 2^nd Bail Application

No.8978/2020 and the complainant as well as injured witnesses

have been declared hostile during trial.

Learned Public Prosecutor has opposed the bail application. 4. Considering the material on record and taking into account the facts and circumstances of the case and the fact that the coaccused-Raju Thehath@ Rajendra@richhapal has already been released on bail and also considering the period of custody and without expressing any opinion on the merits of the case, this petition is allowed.
