The present bail application has been filed under Section 439 Cr.P.C. The petitioner has been arrested in connection with FIR No.13/2021 registered at Police Station Uniyara, District Tonk for the offence under Section(s) 342, 392, 308 & 120-B of IPC and under Section(s) 4 & 25 of Arms Act and later on for the offence under Section(s) 342, 392, 308 & 120-B of IPC.
Learned counsel for the petitioner submitted that he has falsely been implicated in this case. He submitted that the petitioner is in custody since 17.01.2021, investigation as against him is complete and prayed for his release on bail.
Opposing the bail application learned Public Prosecutor submitted that there is grave allegation against the petitioner of committing dacoity and he has been identified in the test

identification parade. He submitted that there are eight more criminal cases registered against the petitioner, most of which are of similar nature and hence, he does not deserve indulgence of bail.
Taking into consideration the submissions advanced by learned counsels for the respective parties, the nature and gravity of allegation against the petitioner, the material contained against him in the case diary, his identification in the test identification parade and his criminal antecedents; but, without expressing any opinion on the merits of the case, this Court is not inclined to enlarge the petitioner on bail.
The bail application is rejected accordingly.
