After arguing the matter for quite some, learned counsel for the accused-petitioner stated that he does not want to press the present bail application but seeks liberty for the petitioner to file fresh bail application after recording the statement of material witness, i.e., neighbour Talsa Ram S/o Tagaji. Learned counsel further requested for issuance of direction to the concerned Trial Court to record the statement of the aforementioned witness on priority basis.

Accordingly and in view of the above submissions, the instant bail application filed under Section 439 Cr.P.C. on behalf of the accused-petitioner, Dilip Kumar @ Daparam S/o Udaram, is dismissed as not pressed with liberty as prayed for.

However, as requested by the learned counsel for the petitioner, the Trial Court concerned is directed to record the statement of Talsa Ram S/o Tagaji on priority basis.
