This second bail application has been filed under Section 439 Cr.P.C. in connection with FIR No.34/2020 registered at Police Station, Chandwaji, District, Jaipur Rural for offence under Section(s) 365, 342 & 395 IPC.

Learned counsel for the petitioner submits that this is a second bail application in changed circumstances as the coaccused has already been released bail. The chage-sheet has already been filed and the petitioner was not identified.

Learned Public Prosecutor has opposed the bail application.

¶14

Taking into consideration the nature of allegations, but without commenting on merits of the case, I deem it just and proper to enlarge the petitioner on bail.

Therefore, this second bail application is allowed and it is ordered that the accused petitioner – Kanchan @ Kalla S/o Amar

Singh be released on bail under Section 439 Cr.P.C. in connection with aforesaid FIR provided the petitioner furnishes a personal bond of Rs.20,000/- with one surety in the like amount to the satisfaction of the concerned Magistrate with the stipulation that he shall comply with all the conditions laid down under Section 437(3) Cr.P.C.
