leaves were recovered which were not accompanied by the fruiting tops, which do not fall within the definition of Ganja. It is also contended that the petitioner is owner of the pick up. As per the information received, petitioner was selling Ganja in House No.112, Hanuman Vatika, Nangal. No investigation was done with regard to the offence under Section 8/20 of N.D.P.S. Act. The person who conducted the search was not an authorised officer. It is also contended that petitioners are not having any criminal antecedent of like nature.
