This second bail application has been filed under Section 439 CrPC in connection with FIR No. 28/2020 registered at Police Station- Soorwal, Dist. Sawaimadhopur for the offences under Sections 366, 376-D, 384, 343, 370 and 120Bof IPC and Sections 3 (1) (va) (1) and Section 3 (2) (v) of SC/ST Act.

Learned counsel for the petitioner submits that statement of the prosecutrix and her husband have been recorded and both the witness have specifically stated that Ramavtar (petitioner) was not involved in the abduction of the prosecutrix while they have levelled allegations against other accused.

Learned Public Prosecutor on the other hand submitted that in her statement under Section 164 Cr.P.C., prosecutrix mentioned the name of the petitioner.

Heard learned counsel for the petitioner and learned Public Prosecutor appearing for the State and carefully scanned the relevant material available on record.

I have reflected over the submissions.

Taking into consideration the statements of the witnesses made in the court but without commenting further on the merits of the case, I am inclined to release the petitioner on bail.

Therefore, this bail application is allowed and it is ordered that accused petitioner Ramavtar S/o Shri Laxmi Narayan, shall be released on bail under Section 439 CrPC in connection with aforesaid FIR provided he furnishes a personal bond of Rs.40,000/- with two sureties in the like amount to the satisfaction of the concerned Magistrate with the stipulation that he shall comply with all the conditions laid down under Section 437(3) Cr.P.C.
