This Criminal Misc. Second Bail Application has been brought under Section 439 of Cr.P.C., seeking regular bail in connection with F.I.R. No.160/2019 registered with Police Station, Fatehpur Sadar, District-Sikar for offence under Sections 323, 324, 307 and 34 of IPC and Section 27 of the Arms Act.

Heard learned counsel for the accused petitioner.

It has been argued on behalf of the petitioner that this is second bail application. The First bail application was dismissed on 14.10.2020. It is submitted that the main accused-Surendra Kumar has been granted bail by the Co-ordinate Bench of this Court on 25.11.2021. The case of the petitioner is on better footing. The allegation of causing injury from firing has been attributed to the main accused-Surendra Kumar, who has already

been granted benefit of bail.

Learned Public Prosecutor has opposed the bail application.

I have considered the contentions.

On consideration of arguments/submissions of both the parties, perusal of material on record, nature of accusations and looking to the facts and circumstances of the case, but without commenting upon detailed merits of the case, this court deems it fit to enlarge the accused-petitioner on bail.

Therefore, the second bail application is allowed. Accusedpetitioner Anil Kharshu S/o Balraj shall be released on bail in FIR No. 160/2019 registered with Police Station Fatehpur Sadar, District-Sika r , if he is not wanted in any other case, provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lakh) together with two sureties in the sum of Rs.50,000/(Rupees Fifty Thousand) each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
