Heard learned counsel for the petitioners as well as learned Public Prosecutor and also perused the material on record.

The petitioners have been arrested in connection with FIR No.83/2021 of Police Station Kheroda, District Udaipur for the

offences punishable under Section 395 IPC. They have preferred these bail applications under Section 439 Cr.P.C.

Learned counsel for the petitioners submits that the investigation has completed and chargesheet has already been filed. The other co-accused person in the present case have already been enlarged on bail by the co-ordinate Bench of this Court vide order dated 16.11.2021 passed in S.B. Criminal Misc. Bail Application No.14667/2021. Learned counsel for the petitioners further submits that the petitioners are in judicial custody since long and the conclusion of trial will take sufficient time to be completed, therefore, the petitioners may be granted benefit of bail during the course of the trial.

Learned Public Prosecutor has opposed the bail applications. Having regard to the totality of the facts and circumstances of the case, particularly looking to the fact that the chargesheet have already been filed and the other co-accused persons have already been enlarged on bail by the co-ordinate Bench of this Court, in the peculiar facts and circumstances of the matter, without expressing any opinion on the merits of the case, this Court deems it just and proper to grant bail to the accused petitioners under Section 439 Cr.P.C.

Accordingly, these bail applications filed under Section 439 Cr.P.C. are allowed and it is directed that petitioners Ritik S/o Dal Chand and Rahul S/o Vishnu shall be released on bail in connection with FIR No.83/2021 of Police Station Kheroda, District Udaipur provided each of them executes a personal bond in a sum of Rs.50,000/- with two sound and solvent sureties of Rs.25,000/each to the satisfaction of learned trial court for his appearance
