The petitioner has filed this bail application under Section 439 Cr.P.C. in connection with FIR No.0096/2021 registered at Police Station Kishangarh District Ajmer for the offences under Sections 363, 342, 376 IPC, Section 3/4 of the POCSO Act and Section 3(2)(va) of S.C.S.T. Act.

Heard learned counsel for the accused-petitioner and learned Public Prosecutor appearing for the State and carefully scanned the relevant material made available on record.

Learned Public Prosecutor has opposed the bail application.

Taking into consideration the nature of allegations and the age of the girl being between 17-18 years as well as allegations of her father of taken away the jewellery on her own and also taking into consideration that the trial is likely to take time but without

expressing any opinion on the merits and demerits of the case, I deem it appropriate to enlarge the accused-petitioner on bail.

Therefore, this bail application is allowed and it is directed that accused-petitioner namely, Rakesh Singh S/o Shri Ramchandra shall be released on bail under Section 439 Cr.P.C. in connection with aforesaid FIR, provided he furnishes a personal bond in the sum of Rs.20,000/- together with one surety in the like amount to the satisfaction of the concerned Magistrate with the stipulation that he shall comply with all the conditions laid down under Section 437(3) Cr.P.C.
