Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the case diary.

The petitioner has filed this anticipatory bail application under Section 438 CrPC in connection with FIR No.154/2019 registered at Police Station Kuchaman City, District Nagaur. for offence under Sections 143, 341, 323, 353, 332, 504 of IPC.

Learned counsel for the petitioner has submitted that the petitioner was not named in the FIR, which was registered on 02.07.2019. It is submitted that during the course of investigation and in the initial charge-sheet, petitioner’s name does not appear in the statements of witnesses examined in the first round of investigation. However, in subsequently recorded statements, the petitioner has been named as one of the assailants along with his father namely Hema Ram. It is further submitted that so far as

father Hema Ram is concerned, he has already been granted benefit of anticipatory bail by this Hon’ble Court vide order dated 05.04.2021 in S.B. Criminal Misc. Bail Application No.2659/2021 and case of the petitioner is not different from him, therefore, he may also be granted similar kind of relief and benefit of pre-arrest bail under Section 438 Cr.P.C.

In this view of the matter, having regard to the facts and circumstance of the case and looking to the fact that co-accused Hema Ram who is father of the petitioner has already been granted bail, this Court is of the view that the petitioner deserves grant of anticipatory bail.

Accordingly, this bail application under Section 438 CrPC is allowed and it is ordered that in the event of arrest of petitioner Deepak Choudhary S/o Hema Ram in connection with FIR No.154/2019 registered at Police Station Kuchaman City, District Nagaur., he shall be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with sound & solvent two sureties of Rs.25,000/- each, to the satisfaction of concerned Investigation Officer, subject to the following conditions:

That he shall not leave India without prior permission by concerned trial court;

That he shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police office;

3 That he shall make himself available for interrogation

by a police officer as and when required.
