Petitioner has filed this bail application under Section 439 of Cr.P.C.

F.I.R. No.01/2020 was registered at Police Station Cyber Crime, Jaipur for offence under Sections 419, 420, 465, 120-B of I.P.C. and 66-D of I.T. Act.

It is contended by counsel for the petitioner that offence is triable by First Class Magistrate. Petitioner has remained in custody for a period of about one year. Co-accused has been enlarged on bail.

Learned AAG along with Investigating Officer and counsel for the complainant have opposed the bail application. It is contended

that petitioner came to India on student visa in 2016. He had obtained passport and visas in two different names and was actively involved in the offence. Similar type of offence is also committed in Hisar, Haryana, where investigation under Section 173(8) of Cr.P.C. is pending but the links are available, which goes to show that present petitioner was also involved in that case. It is contended that petitioner has cheated the complainant to the tune

of more than one crore rupees.

I have considered the contentions.

Considering the contentions put forth by learned AAG and counsel for the complainant, I am not inclined to entertain the bail application.

This bail application is accordingly dismissed.
