Heard learned counsel for the parties.

The applicant has preferred this anticipatory bail application under Section 438 Cr.P.C. apprehending his arrest in connection with F.I.R. No. 42/2020 registered at Police Station Osian, District Jodhpur for offences under Sections 420, 467, 468, 471 of IPC.

It is submitted by learned counsel for the applicant that based on the allegations made in the FIR, which was lodged way back on 14.02.2020, no case as alleged is made out against the applicant, the FIR is highly belated, as it pertains to the elections, which have been held in the year 2015. The allegations have no substance. It is submitted that only on account of political rivalry, the FIR has been lodged and the applicant is apprehending arrest now, therefore, anticipatory bail be granted.

Learned Public Prosecutor and learned counsel for the complainant opposed the present bail application.

Having regard to the totality of the facts and circumstances of the case and without expressing any opinion on the merits of the case, I am inclined to grant anticipatory bail to the present applicant.

Accordingly, the bail application is allowed and it is directed that in the event of arrest of applicant - Jagram Bishnoi S/o Sh. Rid Mal in connection with F.I.R. No.42/2020 registered at Police Station Osian, District Jodhpur, the applicant shall be released on bail; provided he furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) along with two sureties of Rs.25,000/- (Rupees Twenty Five Thousand only) each to the satisfaction of the concerned Investigating Officer/S.H.O. on the following conditions :-

(i). that the applicant shall make himself available for interrogation by a police officer as and when required;

(ii). that the applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer; and

(iii). that the applicant shall not leave India without previous permission of the court.
