The present criminal appeal under Section 14(A) (2) of the SC/ST (Prevention of Atrocities) Act has been filed in connection with FIR No.250/2021 registered at Police Station Kotwali Tonk, District Tonk for the offences mentioned therein.

Learned counsel for the accused appellant submits that the appellant has been falsely implicated in the present case as he has nothing to do with the alleged incident. There is major contradiction in the statement of prosecutrix. Appellant has no criminal antecedents. Counsel further submits that the accused appellant is behind the bars since long. Charge-sheet has already been filed. Conclusion of the trial may likely to take time. Hence, the accused appellant be released on bail.

Learned Public Prosecutor assisted by learned counsel for the complainant have opposed the appeal.

Keeping in view the facts and circumstances of the case, it would be just and expedient to order the release of the appellant on bail.

The impugned order passed by the learned Court below is set-aside, this appeal is allowed and it is directed that accused appellant Shanu @ Mohammad Shabbir Son Of Mohammad Sharif shall be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- together with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned Trial Court with the stipulation that he shall appear before that Court and any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
