These criminal appeals under Section 14(A) (2) of the SC/ST (Prevention of Atrocities) Act has been filed in connection with FIR

No.209/2021 registered at Police Station Anantpura, Kota City for the offences under Sections 341, 323, 452, 308, 325, 34 IPC, Section 4/25 of Arms Act and Section 3(2) (va) Of SC/ST (Prevention of Atrocities) Act.

Learned counsel for the appellants submits that the appellants have been falsely implicated in this matter. They are behind the bars since long and conclusion of trial may take long time, hence the accused-appellants be released on bail.

Learned Public Prosecutor has opposed the appeals.

Keeping in view the facts and circumstances of the case, it would be just and expedient to order the release of the appellants on bail.

These appeals are allowed and the order 5.8.2021 passed by the learned Special Judge SC/ST (POA) Act Cases, Kota is quashed and set-aside. It is directed that accused appellant

Manoj Singh @ Golu S/o Shri Rajendra Singh, Buddhraj S/o Shri Pokharmal and Kamal Singh Urf Picchu S/o Rajendra Singh shall be released on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) together with two sureties in the sum of Rs.25,000/(Rupees Twenty Five Thousand Only) each to the satisfaction of the learned Trial Court with the stipulation that they shall appear before that Court and any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
