The matter comes up for orders on an application (I.A. No. 1/2021) filed by the applicant praying therein to take the compromise deed dated 22.01.2021 on record while allowing the appeal and to quash and set aside impugned judgment and decree 21.07.2007 passed by the Court of Additional District Judge, (Fast Track) No.2, Ajmer in light of the aforesaid compromise deed.

Learned counsel for both the parties submits that the parties have amicably settled their dispute out of the Court in the spirit of Lok Adalat after entering into compromise dated 22.01.2021, duly notarized by the Notary Public. Both the parties jointly filed an application on 02.12.2020 before the learned Executing Court

along with the copy of the compromise, which was taken on record.

The appellant-defendant and respondent-plaintiff are personally present before the Court, their presence is identified by their respective counsels, both the parties jointly submit that they have no objection if the impugned judgment and decree 21.07.2007 passed by the Court of Additional District Judge, Fast Track No.2, Ajmer is quashed and set aside in the light of the aforesaid compromise deed.

In view of the above, the present first appeal filed by the appellant-defendant is allowed and the impugned judgment and decree 21.07.2007 passed by the Court of Additional District Judge, Fast Track No.2, Ajmer is quashed and set aside in the light of the aforesaid compromise deed.
