Heard learned counsel for accused appellant and learned Public Prosecutor on application for suspension of sentence.

Learned Public Prosecutor has opposed the application for suspension of sentence.

I have considered the submissions made by learned counsel for the parties and perused the record.

After having perused the record and the judgment passed by the trial court and the observations made in Para 44 of the judgment and also taking into consideration that the accused appellant was on bail during trial, I am inclined to allow this application for suspension of sentence.

Accordingly, application for suspension of sentence is allowed and it is ordered that sentence awarded to accused-appellant namely, Saurav Rajput S/o Averan Singh by learned trial court

vide its judgment 20.2.2020 in Sessions Case No.93/2018 shall remain suspended during pendency of the appeal and he be released on bail, provided he furnishes a personal bond in the sum of Rs.1,00,000/- with one surety in the like amount to the satisfaction of the trial court with the stipulation that he shall appear before this court on 2.11.2020 and as and when called upon to do so.
