This intra-court appeal is directed against the order dated 08.11.2019 passed by learned Single Judge of this Court whereby prayer of the appellant/writ-petitioner for interim relief has been rejected while observing that grant of interim order as prayed for, shall amount to finally allowing the writ petition.

By way of interim relief, the appellant/writ-petitioner had prayed that the respondents be directed to consider the application of the appellant for increasing the intake capacity of students from 50 to 100 for two years’ Diploma Course.

Obviously, the final relief prayed for in the writ petition, cannot be allowed by way of interim relief, and thus the order under appeal passed by learned Single Judge does not suffer from any error so as to warrant interference by us in exercise of intracourt appeal jurisdiction.

The special appeal is, therefore, dismissed.

At this stage, learned counsel appearing for the appellant submits that the learned Single Judge may be requested to decide the writ petition expeditiously.

It is always open for the appellant to make appropriate application in this regard before the learned Single Judge.
