The brief facts relevant for the present purposes are that when the petitioners applied pursuant to the advertisement No.1/2018 dated 12.4.2018, the area where the petitioners reside, was not a TSP area, and was declared as a TSP area subsequently.
Learned counsel for the petitioners submits that the petitioners are entitled to be posted in TSP area in the light of judgment of this Court rendered in case of Jai Singh V/s State of Rajasthan and Others [SBCWP No. 10473/2019, decided on 24.7.2019].
Mr. Kailash Chaudhary, learned counsel appearing for the respondents submits that though the principal controversy involved in the present case is covered by the decision rendered in the case of Jai Singh (supra), however petitioner cannot be moved now and whenever next posting-transfer will be made, the law laid down by this Court would be given effect to.

In view of the aforesaid, the present writ petition is disposed of with a direction to the respondents to provide appropriate posting to the petitioners in TSP area as held by this Court in Jai Singh’s case (supra).
The stay application also stands disposed of accordingly.
