Petitioner has filed the petition under Article 226 of the Constitution of India seeking fourth regular parole for forty days.

Learned counsel for the petitioner has submitted that the petitioner is in custody for the last more than fourteen years and his jail conduct is satisfactory. Social Justice and Empowerment Department has recommended the case of the petitioner for his release on parole vide Annexure-R/2. Petitioner had surrendered before the concerned authority on due date after availing three paroles.

Learned State Counsel has opposed the petition. Keeping in view the facts and circumstances of the case, it would be just and expedient to order release of the petitioner on fourth regular parole for forty days.

Accordingly, this petition is allowed. Petitioner be admitted to fourth regular parole for forty days subject to the satisfaction of the respondent no.3.
