The matter comes up on a petition filed under Article 226 of the Constitution of India for releasing the petitioner on first regular parole of 20 days.

Report has been received. Reply has also been filed.

It is submitted that the conduct of the present petitioner in the Jail is satisfactory, however, an adverse report has been submitted by the police, which has resulted in his rejection of the parole.

Rule 9 of the Rajasthan Prisoners (Release on Parole) Rules, 1958 provides for grant of first regular parole of 20 days subject to good conduct in Jail on completion of 1/4th of sentence awarded. Admittedly, the petitioner has completed 1/4th sentence awarded to him.

Taking into consideration the reply filed by the State and as per the Rajasthan Prisoners Release on Parole Rules, 1958, which provides release on first regular parole, I deem it appropriate to allow this petition and grant first regular parole to the petitioner for 20 days i.e. from 25.11.2020 to 14.12.2020.

Accordingly, this writ petition is allowed and direct the Superintendent, Central Jail, Jaipur to release the accused petitioner, namely, Rajesh @ Dayanand S/o Shri Mool Chand, on regular first parole for a period of 20 days, which shall commence from the date of his release, upon furnishing a personal bond in a sum of Rs.20,000/- with one surety in the like amount to the satisfaction of the Superintendent, Central Jail, Jaipur with the stipulation that he shall surrender himself and return back to the concerned Central Jail. He shall maintain peace and tranquility during the period of first regular parole, which will include journey period also. In case, he fails to surrender on the stipulated day, the jail authority shall proceeded in accordance with law.
