Petitioner has filed the petition under Article 226 of the Constitution of India, seeking Third Regular Parole for 40 days.
Learned counsel for the petitioner has submitted that the petitioner has undergone nine years and nine months of actual sentence. Jail conduct of the petitioner is satisfactory. Petitioner had availed two regular paroles and had surrendered within the stipulated period and had not misused the concession of parole. Presently, petitioner is lodged in Open Air Camp, Karauli.

Learned State counsel has opposed the petition, but has failed to controvert the factual aspect of the submissions made by the learned counsel for the petitioner.
Keeping in view the facts and circumstances of the case, it would be just and expedient to order the release of the petitioner on Third Regular Parole for 40 days.
Accordingly, this petition is allowed. Petitioner be released on Third Regular Parole for 40 days subject to the satisfaction of Respondent No.4.
