This second bail application has been filed under Section 439 CrPC in connection with FIR No. 123/2020 registered at Police Station Dablana District Bundi(Raj.) for the offences under Section 323, 341, 326, 147, 148 & 149 IPC.

Heard learned counsel for the petitioner as well as learned Public Prosecutor.

The first bail application was withdrawn by learned counsel and has now filed the second bail application after the submission of the charge sheet. As per charge sheet, the case registered against the petitioner is u/s 326 IPC apart from the other offences.

Learned counsel for the petitioner submits that charge sheet has been filed and the trial is likely to take time.

I have considered the submissions.

Taking into consideration the change circumstances and the nature of the allegation against the petitioner and that the trial is likely to take time considering the situations of the Covid-19 pandemic, without commenting on merits, I deem it just and proper to enlarge the petitioner on bail.

Therefore, this bail application is allowed and it is directed that accused petitioner -Bharatram @ Bhartya @ Katiya S/o Jailya Alias Naheriya shall be released on bail under Section 439 CrPC in connection with aforesaid FIR provided he furnishes a personal bond of Rs.20,000/- with one surety in the like amount to the satisfaction of the concerned Magistrate with the stipulation that he shall comply with all the conditions laid down under Section 437(3) Cr.P.C.
