This bail application has been filed by the petitioner under Section 439 CrPC seeking regular bail in FIR No. 184/2020 registered at Police Station, Kotputli, Jaipur Rural for the offence under Sections 498A and 304-B IPC.

Learned counsel for the petitioner has submitted that after investigation, the challan has been filed. The petitioner was not present at the time of occurrence. Neither any demand of dowry was made by the petitioner from the deceased nor he humiliated her. Deceased Shivani went on the roof to dry the clothes, where from her leg was slipped and she fell down. The petitioner is in judicial custody since long and the conclusion of trial is likely to take long time, hence he may be enlarged on bail.

Learned PP appearing for the State assisted by the counsel for the complainant have opposed the same. He submits that since marriage, the accused party were demanding dowry from the deceased. The petitioner was present at the time of occurrence and this fact was fortified from the statement of witnesses, hence he should not be enlarged on bail.

Considering the submissions of learned counsel for the parties and taking into consideration the overall facts and circumstances of the case and more particularly in view of seriousness of allegations against the petitioner, I do not deem it just and proper to enlarge the petitioner on bail.
