Heard learned Public Prosecutor and the counsel for the appellant and perused the judgment impugned.
This Court is of the opinion that there are valid and substantial grounds for grant of leave to the appellant for filing the appeal against the acquittal of the respondent vide impugned judgment.
Accordingly, the application for grant of leave to appeal is allowed. The memo of leave to appeal be treated as an appeal and it be registered as such.
Admit. Record of the case has already been received.
Accordingly the respondent No.2 Kamlesh Kumawat is directed to mark his attendance before the Registrar (Judicial), Rajasthan High Court, Jodhpur on or before 03.02.2020 and furnish bail bonds in the sum of Rs.30,000/- with a surety in the like amount to the satisfaction of the Registrar (Judicial), Rajasthan High Court, Jodhpur.
