This revision petition has been filed by the petitionerdefendant (hereinafter referred to as 'the defendant') against the

order dated 15.04.2019 passed by Addl. District Judge No. 2, Jaipur Metropolitan, Jaipur in Civil Suit No. 08/2012, whereby the application filed by the defendant under Order 7 Rule 14 CPC has been rejected.

The respondent Nos.1 to 3-plaintiffs (hereinafter referred to as 'the plaintiffs') filed a suit for declaration and permanent injunction against the defendants. The defendant filed an application under Order 7 Rule 11 CPC. After hearing the arguments, vide order dated 15.04.2019 the Trial Court rejected the application under Order 7 Rule 11 CPC.

Hence, the present revision petition has been filed.

After arguing the matter at some length, learned counsel for the defendant seeks permission to withdraw the revision petition. At the same time it is prayed that the Trial Court be directed to frame preliminary issue in respect of objection raised in the application under Order 7 Rule 11 CPC and decide the same before proceeding further in the matter.

The revision petition is dismissed as withdrawn. However, the Trial Court is directed that if the defendant raises the same objection in his written statement, as has been raised in the application under Order 7 Rule 11 CPC and if a preliminary issue is found to have been made out under Order 14 Rule 2 CPC, then a preliminary issue be framed and the same be decided by the Trial Court first without being influenced by its earlier order dated 15.04.2019.
