This is second application for suspension of sentence filed by applicant-Dhananjay Singh.

Learned counsel for the applicant though made arguments on merits, but also additionally stated that after dismissal of the first application for suspension of sentence on 4.7.2017, the appeal has not been listed for hearing.

It is contended that even though this Court in the order dated 8.2.2018 while dismissing the second application for suspension of sentence filed by co-accused Gopal Mandal has directed the registry to list this appeal for hearing, yet the appeal

has not been listed for hearing. The applicant is in jail for more than three years and the paper book has been prepared and checked.

Having heard the learned counsel for parties, we are not inclined to reconsider the second application for suspension of sentence on merits, particularly when the first application has been dismissed on consideration of the entire evidence. However, considering that appellant is in jail for more than 3 years, we direct that the appeal be listed for hearing on 14.10.2019.

The second application for suspension of sentence is dismissed.
