This appeal on behalf of appellants is directed against the judgment dated 24.09.2019 of learned Single Judge by which their writ petition was dismissed with a cost of Rs.20,000/-.
In the writ petition, the appellants had challenged the guidelines issued by the respondent State awarding bonus marks to the employees working in 108 Ambulance services. The learned Single Judge dismissed the writ petition holding that none of the appellants’ right has been taken away inasmuch as the appellants cannot dictate term relating to advertisement for award of bonus marks to a particular set of employees.
It is not in dispute that the bonus marks have also been prescribed for the employees working in 108 Ambulance services through placement agencies or ‘non-governmental organization’, apart from the employee actually working in the schemes of the State Government and therefore the objection raised by the petitioners as to award of bonus marks to them cannot be sustained in law. However, considering the submission made by learned counsel for the appellants, we are inclined to waive the costs of Rs.20,000/- imposed by learned Single Judge.
The appeal is accordingly disposed of. This also disposes of stay application.
