Sampat Vs State of Rajasthan

The corpus Mst ‘K’ is present in the Court with her father. She states that she is living satisfactorily at her father’s house. However, she is affirmative that upon completing 18 years of age which event would fall on 26.09.2019, she wants to go with the man, she likes.

The petitioner Sampat (father of the corpus Mst. ‘K’ ) present in the Court does not object to this request made by the corpus. He assures that he shall not marry Mst. ‘K’ against her desire and that he shall allow her to continue her education.

In view of the assurance given by the petitioner and the desire expressed by Mst. ‘K, we direct that the corpus shall continue to live with her father till she attains majority. Thereafter, she shall be free to proceed as per her desire.

The habeas corpus petition is disposed of accordingly. Rule is discharged.
