A copy of the writ petition has been served on Mr. Manish Patel, AGC.

This writ petition has been filed by the petitioner seeking a direction to the respondents to call the petitioner for documents verification and counseling for the post of LDC pursuant to the advertisement dated 14.02.2013 against the available vacant posts.

It is submitted by learned counsel for the petitioner that the issue raised in the writ petition is similar to that in the case of Jiya Devi vs. State of Rajasthan & Ors. : S.B. Civil Writ Petition

No.10796/2018 decided on 25.07.2018 that the State has also

issued a circular dated 29.05.2018 providing for a contingency wherein those who could not appear for documents verification pursuant to the circular dated 06.09.2017 / 02.04.2018, their cases may be considered subject to the candidate standing in the cut-off, being eligible and there being availability of posts in the category of the petitioner and therefore, the petitioner may be accorded the same relief.

Counsel for the respondents, though does not dispute the passing of the judgment in the case of Jiya Devi (supra) and the circular dated 09.05.2018, it is submitted that the petitioner has approached this Court belatedly and therefore, he is not entitled to any relief.

In the circumstances of the case wherein the State Government itself by circular dated 29.05.2018 has provided for consideration of the case in terms of the directions issued by the Court and that similar directions have been issued in the case of Jiya Devi (supra), there is no reason to deny the same relief to the petitioner.

In view of above, the writ petition filed by the petitioner is disposed of with the direction to the respondents to consider the case of the petitioner for appointment to the post of LDC pursuant to the advertisement dated 14.02.2013 strictly as per his merit, eligibility and availability of vacant position in his category.

Needful may be done within a period of eight weeks.
