The present writ petition has been filed, laying challenge to the award dated 07.01.2019, passed by the learned Motor Accident Claims Tribunal, Dungarpur in Claim Case No.189/2017, whereby a sum of Rs.9,000/- has been awarded to the claimants.
Looking to the smallness of the amount involved, learned counsel for the petitioner seeks permission to withdraw the present writ petition, however, with a prayer that the finding arrived at while adjudicating the present claim case along with other cases should not prejudice petitioner’s right to assail the findings recorded in the judgment and award dated 07.01.2019.
The request made by the petitioner appears to be reasonable.

The writ petition is, therefore, dismissed as withdrawn with an observation that the finding recorded while passing the award dated 07.01.2019, impugned in the present writ petition, shall not be treated as final, simply because the writ petition has been dismissed as withdrawn.
