Mr.Mahendra Sharma counsel for the petitioners submitted that the issue agitated in this petition is on all fours covered by the judgment dated 13.2.2019 passed in the case of Ashok Kumar Choudhary vs. The State of Rajasthan & Others SBCWP No.933/2019 . He states that the relief granted to Ashok Kumar Choudhary (supra) be therefore similarly granted and this petition be disposed of in terms thereof.

Dr.V.B. Sharma is not in a position to controvert the submission of the petitioners’ counsel, as indeed the petitioners’ case is covered on facts and the issue generated thereon by the judgment of this court in the case of Ashok Kumar Choudhary (supra).
This petition is therefore disposed of accordingly in terms of the judgment in case of Ashok Kumar Choudhary (supra). The observation/ direction therein shall apply mutatis mutandis to the case of the petitioners.
