Mr. Choudhary, learned counsel for the petitioner informing that the suit from which the present writ petition emanates itself has been decided and the petitioner has filed an appeal against the final judgment and decree, seeks permission to withdraw the present writ petition.
Permission granted.
The writ petition and so also the stay application is dismissed as withdrawn.
Needless to observe that dismissal of present writ petition will not come in the way of the petitioner to challenge the impugned judgment and decree in the appeal said to have been filed by the petitioner.
